Union Cabinet on Wednesday approved an ordinance making triple talaq a penal offence. The offence to be cognisable only when FIR filed by victim wife or her close relations by blood or marriage, Union Minister for law and justice Ravi Shankar Prasad said.
Despite the Supreme Court annulling it last year, the practice continued “unabated”, he said. The ordinance was brought in after the government had failed to pass it through both houses of Parliament.
Though the bill to criminalise talaq-e-biddat was passed by the Lok Sabha in the winter session of Parliament, it got stuck in the Rajya Sabha with the opposition parties having reservations over criminal provisions in the draft law.
Prasad said the offence will be compoudable and it can be compromised only at the insistence of the wife upon appropriate terms and conditions as determined by the magistrate. A bail can be granted by the magistrate upon reasonable grounds but only after hearing the victim wife, he added.
